A Federal Court judge has reserved a decision on expanding the criteria for who can currently grow their own medical marijuana.

Lawyer John Conroy appeared in Vancouver court on Friday to ask Judge Michael Phelan to vary a ruling he made in February that struck down legislation requiring patients to buy medical marijuana from designated growers.


Phelan gave the Liberal government six months to come up with a new law and extended an injunction allowing 28,000 medical patients to continue growing or possessing cannabis.

Mar 29, 2016 Statement from Health Minister Philpott confirms Canada's way forward on marijuana
OTTAWA - Today, the Honourable Jane Philpott, Minister of Health, issued the following statement regarding the matter of Allard v. Canada:



Following a careful review of the Federal Court's decision in the matter of Allard v. Canada, the Government of Canada has decided not to appeal the decision. In the coming months, the Marihuana for Medical Purposes Regulations (MMPR) will be amended to give effect to the Court's judgement. The Government's intention is to have completed the amendment process by August 24, 2016, which is the timeframe set by the judgement.

In the meantime, I would like to remind authorized medical marijuana users that the MMPR remain in full effect. Unless one is covered by a Court injunction, Licensed Producers are the only legal way to obtain marijuana for medical purposes.

At the same time, our Government will be moving forward with the legalization, strict regulation and restriction of access to marijuana. In the near future, a Task Force will be established that will consult broadly with experts in public health, substance abuse and law enforcement in order to examine and report on all of the issues related to legalization.

NEWMARKET - A huge undercover police sting that saw a medical pot-grower dragged through the courts for two years ended with a grand slam in court Thursday - a $10 fine.

"This is ludicrous," an exasperated Clifford Dawson said outside court. "This cost the taxpayers millions and two years of my life. All for $10? Does this make any sense?"


Dawson, 34, of Innisfil, who walks with a cane and suffers from scoliosis, pleaded guilty to production of marijuana.

Health Minister Rona Ambrose ordered a crackdown on groups that illegally advertise marijuana and restated the Conservative party's pledge to keep storefront dispensaries illegal Saturday on the eve of the expected launch of a federal election campaign.

"Today I directed Health Canada to create a task force to crack down on illegal marijuana advertising," Ambrose said in a statement.
